TERMS AND CONDITIONS

Please read the terms and conditions below.

  1. The customer agrees to purchase and have install, and the company agrees to supply and install the units and materials as specified int the contract and more particularly described in the survey report. The customer agrees to allow the company to make a technical survey and give reasonable access to the property to the surveyors and installers
  2. Any and all amendments or variations to the written contract and survey report shall and must be in writing on an official contract variation form duly signed by the customer and an authorised representative of the company.
  3. All prices are subject to V.A.T at the current rate at the time of supply payment of the total price (less any deposit paid) shall be made by the customer immediately upon installation of the materials. Interest shall be charged at 2.5% over Barclay bank base rate for the time being in force on any overdue balance on a daily basis until payment. Where the customer has obtained finance through the company the customer aggress to hand the signed completion document to the installer upon installation.
  4. Property in the units and materials shall remain with the company until all monies outstanding from the customer to the company whether under this or any other contract shall have been settled in full and the company reserves the right to remove any units or materials not incorporated in the customers premises in the event of any account being unpaid.
  5. The company does not undertake to move services, fixtures or fitting which are ancillary to the basic structure of the property e.g. radiator, pipes, electricity, telephone or telephone cables and customer shall remove all household fixtures before work is due to commence and it is the responsibility of the customer to make available the free use of water and electricity. The company does not undertake to redecorate or match any interior or exterior finishes.
  6. The company, in the interests of the customer, reserves the right to refer back to the customer or his representative should any detail on the order be in a any doubt and delivery time will be deemed to commence with effect from settlement of all such details. Delivery and/or installation times are quoted in good faith but time is not of the essence and no liability for damages or otherwise shall be incurred by the company should these times be exceeded. Normal delivery/installation times are within 4 to 10 weeks and customers must give the company 4 weeks notice in writing after this period to allow the company to perform the contract.
  7. The company reserves the right to alter specification without notice in keeping with its policy of continuous improvements.
  8. Elimination or prevention of condensation is not and can not be guaranteed.
  9. The company will not accept liability for any minor imperfections in glass which are inherent in the handling of the manufacturing process of the glass.
  10. Guarantee: We guarantee to repair or, at our discretion, replace free of charge any PHOENIX unit which develops a fault of (including the fault of condensation between glasses of the sealed units) due to defective materials or construction if written notice of any such fault or defect is given within ten years of the installation. No guarantee is given concerning the prevention or reduction of condensation (except between the glasses of sealed units) nor does our guarantee extend to damage or faults due to accident, misuse or neglect. The guarantee is given in addition to all your rights under common law and statute.
  11. Cheques shall be made payable to the company. Cheques or cash may be handed to the company’s accredited agent or representative but a copy of the order must be retained by the customer with the payment duly indicated and receipted thereon.
  12. Cancellation provisions (i) The customer will be allowed to cancel this agreement provided the cancellation is in writing and is received at the head office of the company within 7 days of the contract date. This is in addition to and does not affect any statutory cancellation rights the customer may have where this agreement is a linked transaction within the consumer credit act 1974. (ii) All supply and installation are subject to a technical survey in respect of which the customer agrees to allow the company surveyor and installer access to the property. The company reserves the right to cancel the order within 28 days from the survey date or receipt of customers specifications for supply only orders and in this event any monies paid in respect of any windows or doors offered will be refunded.
